Uber driver creepily livestreams videos of his passengers on Twitch

Ride-hailing companies Uber and Lyft have suspended a driver who recorded hundreds of St. Louis-area passengers without their permission and live streamed the video.

The driver, Jason Gargac, told the St. Louis Dispatch he doesn't see anything wrong with broadcasting his riders to a web audience. His channel was public on Twitch, under the name JustSmurf, while he also tweeted about his videos.

Gargac said he is just trying to "capture the natural interactions between myself and the passengers".

He said that at first he had informed passengers that he was recording them, but the videos felt "fake" and "produced". Several passengers contacted by the newspaper said they did not know their rides had been live-streamed, the Post-Dispatch reported, and they said they would not have given the driver permission to record them if they had known.

Regardless, Uber said Gargac's behavior was a breach of their standards and suspended him while they investigated.

The story also raises a host of 21st-century questions about technology, when people should expect privacy and the business models of ride-hailing companies like Lyft and Uber. But the driver faces no legal repercussions for his behavior because Missouri has "one party consent" privacy laws, meaning only one participant in a conversation needs to agree to its being recorded.

Despite the fact that the livestreams were technically legal, Gargac did delete all the videos on Saturday, once his true colors were exposed by the St Louis Dispatch. "This better be (expletive) content, that's all I'm saying", Gargac says as the two women approach. "The driver's access to the app has been removed while we evaluate his partnership with Uber".

"It's a fact-by-fact case", Pate said, "and I don't think there have been any court decisions to deal with this particular issue". He added: "I love doing it". "In regards to our policies, under our Community Guidelines and Terms of Service, we do not allow people to share content that invades others' privacy".

Their conversations and actions were streamed live to the Twitch platform, where viewers - some of whom paid Gargac - watched and commented.

They say they are going to a bar across town, and one of the women tells Gargac she has a crush on a friend she's going to meet. According to the Post-Dispatch, Gargac displayed a small sticker on the back passenger window informing passengers that his vehicle was "equipped with audio and visual recording devices" for security purposes.
