Broncos president of football operations John Elway announced on Wednesday that Kelly has been released.

Kelly and attorney Harvey Steinberg declined to answer reporters' questions on their way out of the courtroom.

Kelly appeared in court Wednesday morning, and he has another court date set for November 8.

The man was detained without incident and he identified himself to officers as Kelly.

According to court records, a couple reported that a stranger entered their home in the Denver suburbs after 1 a.m. Tuesday, sat down on their couch and was "mumbling incoherently".

The latest reporting from NFL Media's James Palmer backs up that notion and adds more information about what led to Kelly's arrest. Responding officers then searched the area, police said.

This is not Kelly's first run in with the law or having his name in headlines for misconduct.

Kelly - who is the nephew of famed Buffalo Bills quarterback Jim Kelly - had attended a Halloween party in Englewood Monday night, hosted by teammate Von Miller. He has eight touchdown passes and nine interceptions after throwing for 22 TDs with just seven interceptions last season in Minnesota, where he led the Vikings to the NFC championship game. The Broncos issued the following statement regarding Kelly.

This leaves the Broncos with only 2 QBs on the roster - starter Case Keenum and backup Kevin Hogan (who played at Stanford).

The same year, Kelly was arrested for punching a bouncer and threatening to get his "AK-47 and spray [the] place".

It's hard to trust him even as a modest backup, but Kelly's preseason resume and college statistics will entice at least one organization. He also was arrested after a bar fight in 2014, eventually pleading guilty to a misdemeanour charge of disorderly conduct. Kelly's little brother had been hit out of bounds and a brawl ensued.
