A federal district judge in Texas dealt a blow to the Affordable Care Act on Friday night, deeming the entire legislation unconstitutional without the individual mandate - which was eliminated in the GOP-passed tax bill a year ago.

The deadline to apply for health insurance under the Affordable Care Act is midnight on Saturday, December 15.

In a statement, White House press secretary Sarah Sanders praised the ruling. "Further, the Court declares the remaining provisions of the ACA ... are inseverable and therefore invalid".

Enrollment, which opened on November 1, has reportedly been slow this year, but last year numbers surged just before the deadline.

"Marketing does matter", said Peter Lee, executive director of Covered California, a state-run insurance marketplace.

But boosting sign-ups "was not a priority" for the Trump administration, said Ferguson, now a consultant. The court case argued that all of the pieces of the law were dependent upon each other, so by eliminating the penalty the rest of the law fell apart.

The future of the Affordable Care Act might be hanging in the balance thanks to a federal judge in Texas, but Obamacare coverage isn't over just yet.

The AP's VoteCast survey during this year's elections showed that 59 percent of voters want the government to ensure coverage for all Americans. But they also have pushed up premiums for those who are young and healthy. And about the same share of Americans say it's "very important" that insurers continue to be barred from charging sick people more.
