Apple, already grappling with mounting evidence that its latest iPhone line-up has failed to excite consumers, can ill-afford a sharp hike in import taxes.

Administrative law judge Thomas Pender, a now-retired member of the ITC tribunal that hears patent infringement cases, ruled in September that Apple infringed one of the patents, but cleared the company of infringing the other two.

Despite the injunction, Apple said on Monday that its iPhones remain on sale on mainland China.

A copy of the injunction China Daily obtained on Tuesday said that in the process of reconsideration, the implementation of the order will not be stopped.

After using Qualcomm and Intel modems in iPhones for years, Apple might be finally looking to build its own modems. The preliminary order remains effective until the court makes a final ruling.

China has been an important market for Apple in recent years since China Mobile agreed to begin distributing the smartphones in 2014, and a number of Apple stores are open in China. The business had revenue of $62.90 billion for the quarter, compared to analyst estimates of $61.55 billion.

Earlier this week, Apple noted that the first injunction wouldn't have much of an impact, if any, on the company's operations in China because all of its devices run iOS 12.

Only the newest range of iPhones will be available following the ban.
