Rod Rosenstein to step down once attorney general is confirmed

  • Rod Rosenstein expected to depart Justice Department in coming weeks following Barr confirmation

Rod Rosenstein, who appointed Special Counsel Robert Mueller to investigate Russian meddling in the USA presidential election, is expected to leave the Justice Department after a new attorney general is confirmed, according to a person familiar with the matter.

The source said Rosenstein is not being forced out, and he has conveyed his thinking to the White House.

Barr's Senate confirmation hearing is expected to begin on January 15, with a confirmation vote expected to follow in the weeks after, likely in mid-February.

Trump nominated former Attorney General William Barr, who served during the Bush administration, to oversee the Department of Justice as AG under Trump.

He has, until recently, overseen Special Counsel Robert Mueller's probe into whether Russian Federation meddled in the 2016 presidential election and has been a target of Trump on Twitter.

Barr submitted a memo to the Justice Department previous year that argued the law doesn't support an inquiry into whether Trump may have obstructed justice if he tried to frustrate the Russian Federation investigation.

Barr asserted that the president had been acting within his executive branch of authority when he made the request and said Mueller "should not be permitted to demand that the president submit to interrogation about alleged obstruction". Soon after, Rosenstein named Mueller as special counsel.

Deputy Attorney General Rod Rosenstein has announced that he will be stepping down from his position shortly. After an embattled turn in that role, Sessions stepped down at the end of a year ago and was replaced temporarily by Matthew Whitaker as Acting Attorney General. Rosenstein's departure has always been the subject of speculation.

Rosenstein was said to have discussed removing Trump from office or secretly recording conversations with him; he said he never authorized any action after those conversations but Justice Department sources said he expected to be fired.

He has accused the investigation of being led by "Democrat loyalists". However, Rosenstein has continued to be the main Justice Department official to interact with Mueller and receive updates on the investigation.
