Trump will sign spending bill, declare national emergency for border wall

Congressional aides said House Democrats were expected to file a lawsuit when Trump declares a national emergency in order to protect the House's constitutional powers to decide how us taxpayers' money is appropriated.

Senior Democrats have responded by accusing him of committing a "gross abuse of power" and a "lawless act".

Trump sparked the last shutdown before Christmas after Democrats snubbed his $5.7 billion demand for the wall.

Trump has not yet said definitively whether he will sign the spending bill, which is causing some anxiety among Republican lawmakers.

The bill, which still needs to pass both legislative chambers, provides $1.383 billion for barriers at the US border with Mexico.

Congress lopsidedly approved a border security compromise Thursday that would avert a second painful government shutdown, but a new confrontation was ignited _ this time over President Donald Trump's plan to bypass lawmakers and declare a national emergency to syphon billions from other federal coffers for his wall on the Mexican boundary.

His authority to do so will nearly certainly be challenged in court.

"I think the president is inclined to accept the agreement and move on and try to find money elsewhere and most likely declare an emergency", said Graham.

However, the aides noted that in the case of a national emergency, the legal provision requires that the funds must be used in support of the armed forces.
